Mississippians are at each other’s throats over the new abortion ban. But for the wrong reasons
Well, it’s happened again. The GOP controlled Mississippi government has enacted a new law prohibiting abortions after 15 weeks. 15 weeks, you may ask, why 15 weeks? The current medical standard for survival outside of the womb is 22 weeks, which is why most states that ban abortion start the ban at 20 weeks. But Mississippi has decided that 15 weeks is the cutoff point. We’ll come back to why later.
Pro-life Mississippians are rejoicing, predictably, and pro-choice Mississippians are bemoaning this law. In the near term, this may make it difficult for some women in Mississippi to get an abortion. But Judge Carlton Reeves has already granted a preliminary injunction in federal court against the law going into effect, which requires a showing of a likelihood of success on the merits. The caselaw and prior experience are against the odds of success in this law’s case. The proponents of the act are hoping that a more conservative US Supreme Court in a few years will hear this case and reverse Roe v. Wade, and they don’t really care that Mississippians are going to continue to voluntarily pay the multimillion dollar litigation cost of this failed experiment.
I suggest that people reverse their perspective. So far, all attempts at bans before 20 weeks have been found unconstitutional. Every single one. And in all of those cases, the states putting forth those bans have had to pay millions in attorney’s fees to the attorneys…
